Documentation is the foundation for communication for patient care, is one of the basic risk management tools, and is a reflection of professionalism and the credibility of the psychiatrist. It is also one of the most rushed or overlooked “required tasks.” Documentation is vital to the defense of a licensing complaint or malpractice allegation and may be reviewed by many others, including the patient and potentially a jury.

Minimizing Risk When Treating Depressed and Suicidal Patients — Denise Neal, RN, BSN, MJ, CPHRM, FASHRM

That COVID-19 has negatively impacted the mental health of Americans, especially related to depression and suicidal ideation, has been established by the American Psychiatric Association, the Center for Disease Control (CDC) and other agencies. The demand for mental health/psychiatric care has expanded rapidly with an increased focus on the role, and some would allege, responsibility, of keeping patients safe. But not all psychiatrists are aware of the potential liability risks with treating depressed and/or suicidal patients or the risk management strategies to mitigate those risks. This webinar will assist participants to identify the potential liability exposures associated with caring for adult and adolescent patients with depression and/or at risk for suicide and will provide practical risk management strategies that can be used right away to help lessen the liability exposures.

Telepsychiatry is an effective means to treat patients and to expand their access to mental health services. This webinar provides an overview of key legal, regulatory, privacy and security considerations, including standard of care, licensure, online prescribing and medication management, informed consent, international telemedicine, as well as anticipated regulatory change and competencies, such as digital literacy. Potential risks with the expanded use of telepsychiatry and risk mitigation strategies when using this modality will be discussed.

With an increase in outpatient behavioral health visits comes an increase in the potential for claims and litigation. It is important for psychiatrists to recognize the types of risks associated without patient behavioral healthcare and how to mitigate those risks. Litigation is expensive and time consuming. Avoiding risk can save the stress it places on psychiatrists and the expense to the practice related to defining behavioral health claims. This webinar will identify the types of risks associated with outpatient behavioral health facilities, recognize situations that may give rise to a medical malpractice claim or licensing complaint, and provide best practices and risk mitigation tools and techniques to avoid a board complaint or medical malpractice claim related to outpatient behavioral healthcare.

Gloria Umali, RN, BSN, MS, MPA, CPHRM
Assistant Vice President, Risk Management Group
Gloria provides risk management consulting services to Allied World’s medical professional liability policyholders and insured psychiatrists, psychologists psychiatric nurse practitioners and physician assistants. She works directly with policyholders to develop individualized action plans to mitigate potential loss based on their unique exposures and risk management needs. Additionally, Gloria assists these clients with ongoing medical educational programs, as well as policy and procedure review and development. Gloria has over 15 years of experience in healthcare risk management, with the last six years serving as a Regional Director of Risk Management for one of the largest hospital systems in the country. Cumulatively, she has over 25 years of experience in nursing and healthcare.

Denise Neal, RN, BSN, MJ, CPHRM, FASHRM
Assistant Vice President, Risk Management Group
Denise has over 29 years of nursing experience with 16 years in healthcare risk management and consulting. She works directly with policyholders to provide risk management consulting services and to develop individualized action plans to mitigate potential loss based on their unique exposures and risk management needs. Additionally, Denise assists these clients with ongoing medical educational programs as well as policy and procedure review and development. Denise has served as a healthcare organization risk manager as well as a legal nurse consultant providing risk management consultative and education services to clinicians and healthcare organizations. Denise is a current board member of the Massachusetts Society for Healthcare Risk Management, serves as the chair of the membership committee and is a member of the program committee.

Allison M. Funicelli, MPA, CCLA, CPHRM, ARM, FASHRM
Assistant Vice President, Risk Management Group
Allison provides risk management consulting services to Allied World’s medical professional liability policyholders and insured psychiatrists, psychologists, and psychiatric nurse practitioners and physician assistants. She works directly with policyholders to develop individualized action, plans to mitigate potential loss based on their unique exposures and risk management needs. Additionally, Allison assists these clients with ongoing medical educational programs as well as policy and procedure review and development. Allison has over 30 years of experience in the
medical professional insurance industry and frequently speaks on national, regional and local levels on topics related to risk management. Allison earned her B.A. degree from SUNY Stony Brook and her MPA degree from Long Island
University with a concentration in health care management. Allison has her Associate in Risk Management and Casualty Claims Law Associate designations.

Tracey Angelo, BSM, CPHRM

Tracey has over 20 years of experience as a healthcare executive in the areas of risk, compliance, insurance, captive management and operations. She has developed innovative risk management solutions for a continuum of care spectrum: acute inpatient, behavioral health, long and short-term care, home health, hospice and outpatient care. A long time member of the Connecticut Society for Healthcare Risk Management, Tracey has served on the Board of Directors as Secretary and President. She is also a member of the American Society for Healthcare Risk Management (ASHRM), the American College of Healthcare Executives (ACHE), the Healthcare Compliance Association (HCCA) and the Connecticut Captive Insurance Assurance Association (CCIA).
